Coonawarra Running Festival Terms and Conditions 2023

General
- These terms and conditions relate to the Coonawarra Running Festival to be held on 9th November 2024 which consists of a 21.1km event a 12km event, a 6km event, a 1km event plus a 5km Wobbly winery Walk event (each individually or collectively as required an Event).
- The Event is being conducted by the Coonawarra Running Festival established as a sub-committee of the Penola Wellness Group (Event Organisers)
- The Event Organisers reserve the right to modify these terms and conditions at any time. It is recommended that participants and volunteers review them regularly. Changes and clarifications will take effect immediately on publication on the Event website. If the Event Organisers make a material change to these terms and conditions we will endeavour to make these known if they will have a significant impact on a participant or volunteer.
- The Event is insured by Lloyds of London Australia Placement.
Covid-19
5. the Event will run in line with the current advice at the time from the South Australian Government.
Conditions of Entry
6. As a participant or volunteer you acknowledge that;
- Participating in the Event is a potentially hazardous activity, which could cause injury or death;
- You will not enter or participate unless you are medically able and properly trained;
- By completing and paying the registration, you certify that you are medically able and properly trained;
- You will abide by any decision of a race official or Event Organiser relating to any aspect of your participation in the Event, including the right of any official to deny or suspend your participation for any reason;
- You have read the terms and conditions and signed the Declaration, Waiver and Indemnity, and agree to abide by them as well as abide by all laws and regular road rules while participating in the Event;
- You assume all risks associated with running in the Event, including but not limited to;
- falls, contact with other participants, the effects of the weather, including rain, cold, high heat and/or humidity, traffic and the conditions of the course including unsealed roads, all such risks being known and appreciated; and
- bicycles, scooters and all wheeled accessories and animals are not allowed in the race and you will abide by all race rules.
- Having read these terms and conditions, knowing the circumstances of participating in the Event and in consideration of your entry, you agree for yourself and anyone you are entitled to act on behalf of to, waive and release the Event Organisers including the Coonawarra Running Festival, the Penola Wellness Group, all event sponsors, their representatives and successors from all claims and liabilities of any kind arising our of your participation in the Event, even though that liability may rise out of negligence or carelessness on the part of the persons named in this waiver;
- By completing and paying the registration, you grant permission to the Event Organisers and all Event sponsors to use your image, photographs, motion pictures, recordings or any other record of this Event for any legitimate purpose in relation to advertising for promotion of the Event website, online materials and print materials;
Refund Policy
9. No refunds will be available for this Event;
10. If the South Australian State government enforces restrictions relating to Covid-19 or any other major event occurs such as a flood, fire or pandemic that, in the opinion of the Event Organisers, means the Event cannot proceed either directly or indirectly due to restrictions, limits on numbers or compliance requirements, participants may be refunded the entry fee minus a $10- administration fee;
11. If there are any threatening weather conditions including thunderstorms, electrical storms, extreme heat, heavy rain or other major weather conditions on the day of the Event, at the sole discretion of the Event Organisers, the Event may be delayed or cancelled. If weather conditions force cancellation of the Event, no refunds can be provided, as the funds will have been spent in preparation for race day;
12. In compliance with these terms and conditions, Event Organisers ay, in the Event Organisers absolute discretion choose to reschedule a delayed or cancelled Event;
Event Withdrawal Policy
13. If a participant withdraws from an Event during their participation, they must advise a course official of their withdrawal. This allows Event Organisers to ensure you are safe and direct you to appropriate assistance;
Privacy
14. When a participant registers for the Event, the Event Organiser collects your personal information such as your name, contact details and email address. As part of the registration you will be asked if you consent to receive emails about the Event and other Event related topics and updates as well as information about similar events;
15. You may withdraw your consent for us to contact you at any time by contacting us on coonawarrarunning@gmail.com;
16. If you would like to access, correct, amend or delete any of your personal information held by Event Organisers, please contact us at coonawarrarunning@gmail.com
Wobbly Winery Walk
1. South Australia has the oldest commercial grapevines in the world. This is because we have never had an outbreak of Phylloxera, an insect that attacks and ultimately kills grapevines. Phylloxera is the number one threat to viticulture in SA as it can be easily carried by humans on footwear, clothing and vehicles. New South Wales and Victoria have experienced the devastation caused by Phylloxera. If you have been in or near vineyards interstate, please ensure your shoes have been cleaned. Please see officials prior to the event to assist you to clean your shoes if required.
2. Remember to keep to the designated Wobbly Winery Walk trail.
3. Do not walk through the vineyards.
4. Have a Phylloxera Foot Bath if necessary.
5. All vineyards are working vineyards, be aware of machinery and vineyard workers.

Declaration, Waiver and Indemnity.
This is to be read in conjunction with the entry form. In consideration of accepting this entry and allowing me to participate in the Coonawarra Running Festival.
Fun Run Committee (Coonawarra Running Festival), I the undersigned (for myself, my heirs, executors and administrators) agree with the Organiser and each Event Sponsor that:
1. I waive, release and discharge the Coonawarra Running Festival Committee and sponsors from all claims or causes of action I may have (including for negligence) arising from any injury, loss or damage of any kind suffered by me including personal injury, illness or death and/or loss or damage to any property (in so far as this does not breach the
provisions of the relevant Australian Consumer Law) arising either directly or indirectly out of my attendance at or participation in the Event.
2. I also waive, release and discharge the Coonawarra Running Festival Committee (Organiser) and the event sponsors as Sponsors and each of their respective officers, employees, contractors, volunteers or
agents involved in the Event from all claims or causes of action I or any person under my care may have (including for negligence) arising from any injury, loss or damage of any kind suffered by any person or property being pushed, carried, accompanied or in any like manner by me. This includes but is not limited to children in prams (in so far as this does not breach the provisions of the relevant Australian Consumer Law) arising either directly or indirectly out of my or their attendance at or participation in the Event. I agree to take all necessary precautions and actions to ensure any child or person accompanying me, whether in a pram or not, is safe.
3. I indemnify and will keep indemnified the Organiser and each Event Sponsor against all costs, losses or damages arising from or in relation to my attendance at or participation in the Event including the attendance or participation of any person in my care.
4. I declare that I am physically fit and have trained sufficiently to participate in and complete the Event.
5. I consent to the free use of my name and pictures of me in any broadcast, telecast and print by the Organiser.
6. I agree to adhere to all event rules and conditions. I understand that I must follow the approved course (endeavouring to keep to the left side of the road at ALL times), observe normal traffic rules and obey all directions and instructions given by event officials and the police. The event organisers reserve the right in their discretion to reject or cancel my entry at any time, including without limitation for safety or insurance
reasons the Coonawarra Running Festival Committee will not be required to refund entry fees in such circumstances.
7. I understand that a large section of the proposed route is on unsealed limestone road.
8. I accept that I must wear the official race bib corresponding to the registration made in my name, and that the allotted number and sponsor’s name can be seen for the duration of the event. No roller skates, roller blades, hand-cycles, geared vehicles, skateboards, bicycles, scooters or accessories that may cause injury will be permitted.
9. I acknowledge that the Event organisers or its representative may remove me from the event area and/or exclude me from participation in the event (i) on medical, health and safety grounds (including to prevent possible harm or injury to myself or any other person), (ii) to prevent damage to any property, (iii) if my behaviour is inappropriate,
offensive, or abusive.
10. I agree to obey and accept the Event rules and any other instructions (whether announced on the day or otherwise) and understand that failure to do so may result in my removal from the event, with no refund given.
11. I agree that the Coonawarra Running Festival Committee reserves the right to refuse entry into the fun run on any grounds.
12. I agree that should the Event be cancelled or if I do not participate in the Event for any reason, my entry fee will not be refunded, and no liability will attach to the Organiser or the Event Sponsors in relation to this.
13. I consent to receive and agree to pay for any medical treatment (including transport by ambulance) which is considered in the reasonable opinion of the Event medical officials to be advisable, before, during or after the Event.
14. I consent to the Organisers entering my personal details contained into a database which will be used for the administration of the event. I also consent to my personal details being used in the following ways:
• To enable Coonawarra Running Festival Committee to contact me regarding this event in future years.
15. I attend and participate in the Event exclusively at my own risk. At all times I have the option of not participating or withdrawing from the Event at any time.
16. Emergency contact name and phone number must be written on the space provided on my race bib and I agree that the Event organisers, or its medical representatives may contact that person and exchange my personal information with them in case of an emergency.
17. The organisers do not guarantee the accuracy of any times or results published on the event website.
18. I hereby acknowledge that I have read, understood and accept these terms and conditions and agree to be bound by them in relation to my attendance at and participation in the Event.
19. The Race Director’s decision is final, and no correspondence or disputes will be entertained.
20. The Organiser makes no other disclosure of entrants’ personal information.
